I have the honour to acknowledge receipt of your father despatch (particulars in margin) and to ask you to convey to H.E. the Governor my thanks for the action he has taken in Singapore regarding the detention of Mr. Boehm.

I must however point out that you have been mis- informed about the place where Mr. Boehm was confined. It was 10 feet square, with a kind of bench all round limiting therefore its space (you will see later the importance of this consideration). The door contained a kind of barred aperture or window, and right opposite to it there was the window whose panes of glass were missing (this particular is established by the fact that on the following day a man was sent to paste up the empty panels with paper). Consequently there was a cross draught of air running through the room during the night, which was a cold damp night. The smallness of the room, as well as the bench around, prevented Mr. Boehm from keeping warm even by walking about outside the draught. He was lightly clad, and as is admitted by you, had not been provided with a blanket, or any covering.

Moreover Mr. Boehm was kept without food for nearly 24 hours. After tiffining with me at Varennes & Co. at 1 p.m. on Saturday he had no food until late in the morning of Sunday 13th. February.

All physical and moral factors were thus accumulated to cause suffering and distress in an innocent man. Prolonged want of food, exposure to cold throughout the night, without any covering and under a cross draught which could not be avoided, and the depressing effects of a sudden and shame ful arrest without any cause being given and any possibility of defence.
